The website www.loritalia.com (hereinafter Website / Site) is owned by the Reggiano Ornithological Laboratory, with registered office in Via Angelo Secchi 10/5 – 42021 Bibbiano (RE) (hereinafter: “LOR” ), and is aimed at selling products online.

Applicable legislation
The purchase and sale of products and services by electronic means is governed by articles from 45 to 67 “Consumer rights” of Legislative Decree 6 September 2005 n. 206 (Consumer Code) and by Legislative Decree 21 February 2014 n. 21 in the field of electronic commerce.
The sales contract stipulated between the Customer and LOR will be governed and interpreted in accordance with Italian law.

All distance contracts relating to the sale of goods entered into between LOR and the customer will be governed exclusively by the following General Terms and Conditions.

In addition to any other term or expression defined herein, the following terms and expressions will have the following meaning: “consumer”: any natural person who purchases (or agrees to purchase) goods from LOR, through the LOR Italia online store , for purposes not related to one’s own commercial or professional business. “Customer”: any person (legal or natural) who purchases (or accepts to purchase) goods from LOR through the LOR Italia online store, including consumers.

By placing an order according to the various methods provided on the Website, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general conditions of sale and payment transcribed below.
These general conditions of sale, together with the conditions regarding the methods of delivery and payment of the goods, form an integral part of the sales contract concluded between the Customer and LOR.

The Customer can purchase the products visible at https://www.loritalia.com/, illustrated on the homepage of the Website within the respective sections by product category, as described in the relevant information sheets.

The products published on the website can be:

– “Available”, that is physically in stock and therefore, as such, can be ordered by the Customer;
– “Not available” in stock. In this case the product cannot be ordered by the customer.
In order to make purchases, the Customer must be registered on the Site.

When the purchase is made, the Customer has the possibility to choose the Payment Method he prefers.
The acceptance of the order by LOR is confirmed by sending a confirmation e-mail to the e-mail address communicated by the Customer when registering on the Site.
LOR reserves the right, at its sole discretion, not to accept the order.
The Customer undertakes to verify the correctness of the data in the order confirmation email and to promptly report any errors or omissions to LOR.

The order confirmation email contains the following data:

– Order number and date
– Product (s), quantity, price
– Payment type chosen
– Cost of Transportation
– Total order amount

The customer can select a form of payment from the list of payment methods presented in the “Payment Methods” section.

With payment by credit card, the invoice amount will be charged to your card immediately after the order is confirmed.

Advance Bank Transfer
The amount of the order will be easily transferable to our account. Only after receipt of payment your order will be processed!

Please keep in mind that it is very important to indicate the order number as a reason so that we can classify and assign the payment to the exact order.

Once the payment has been received (depending on the bank, this can take up to 5 working days!), The order will be processed and can be shipped. The order will not be able to start before the receipt of the money. This means that until the payment reaches our bank, the order will not be processed. Attention: by choosing the advance payment by bank transfer, the products will be actually booked only upon arrival of the transfer. The situation may therefore occur in which at the time of the order all the products are in stock, while at the time of the arrival of the transfer one or more items are no longer available and consequently it will be necessary to wait. LOR confirms the acceptance of the order by sending an automatic summary e-mail to the e-mail address indicated by the Customer in the order itself.

LOR prepares the goods contained in the order and entrusts them to the Courier with the original packaging or with cardboard boxes properly closed with adhesive tape.

Delivery times to the Courier vary according to the payment method chosen and the availability of the product:

Credit card and PayPal : orders acquired by 1.00 pm on Business Days are entrusted to the Courier within two working days following receipt of payment by LOR.
Bank transfer : from the provision of the bank transfer, an average of 3/5 working days pass before the amount is credited to the current account of LOR. All orders are entrusted to the Courier within two working days following receipt of payment by LOR.
Deliveries are made on working days, from Monday to Friday, except holidays (hereinafter “Business Day / s”). By Hours we mean the hours included in the Working Days.

All orders are entrusted to the GLS Courier.

The delivery times of the Courier to the Customer’s home are approximately 1-2 days in Northern and Central Italy, 2-3 in Southern Italy, and are in any case to be considered indicative as they may undergo variations due to force majeure, for uncomfortable traffic conditions. and viability, due to strikes or by act of the Authority.

Delivery costs are charged to the customer and are indicated in the “Shipping costs” section

Upon delivery of the goods by the Courier, the Customer is required to check:

that the number of packages delivered corresponds to what is indicated in the courier’s accompanying document
that the packaging is intact, not damaged, wet or altered.
Once the Courier’s transport document has been signed, the Customer will no longer be able to make any objection regarding the quantity and quality of what has been received.

Delivery is made on working days from 08:30 to 18:00.

In case of standard delivery made by the GLS Courier, the first delivery is made without notice. In case of absence of the Customer, the Courier leaves a notice of passage (slip in the mailbox or sticker on the bell) and retries the delivery on the next working day. In case of further absence, the Customer is contacted directly by the Courier for the third attempt. If this delivery attempt is also unsuccessful, the Customer will be contacted by LOR staff to define a further delivery. If the fourth attempt is also unsuccessful, the product returns to the LOR warehouses with consequent cancellation of the order and subsequent refund according to the chosen payment method.

Attention : the bank transfer does not guarantee an immediate shipment! By choosing the advance payment by bank transfer, the products will be actually booked only upon arrival of the transfer. The situation may therefore occur in which at the time of the order all the products are in stock, while at the time of the arrival of the money one or more items are no longer available and consequently it will be necessary to wait. If you are in a hurry to receive your package, we recommend that you only order products in stock and pay by credit card or paypal.

With the shipment of the package, we also send an email with the tracking code to be able to follow your order in its every movement! Check the status of your order, at any time! Through the traceability code that you will receive by email when the package is shipped, it will be possible to know its status and route! If you haven’t received the email, check the spam, because sometimes it ends there!
In rare cases, tracking is unfortunately not possible.

If you have not received any package within 3-4 days of shipment from us, we recommend that you check the status with the tracking code.

In some periods of the year such as Christmas and the month of August the delivery times to the courier may be longer due to holidays.

Shipping costs depend on the weight of the goods ordered and the destination, and are automatically calculated on the checkout page once the destination has been entered.

Unless otherwise agreed, the products will be delivered by LOR to the delivery address specified by the customer.

If LOR is unable to ship the chosen products because a supplier does not meet its contractual obligations, LOR can withdraw from the customer’s order, we will inform you immediately.

If a delivery to the customer was not possible for several reasons:

– Customer not available at the address indicated
– Incorrect or incomplete address indicated (for example without the house number)

and although the dispatch of the package has been announced in a reasonable time to the customer, he will assume the shipping costs.

Shipping costs are charged to the customer, as stated on the site. Shipping costs will be indicated both on the site and in the cart. The cost of any special delivery procedures or special packaging requested by the customer will be borne by the latter.

LOR reserves the right to make partial shipments, unless this is unreasonable for the customer. Any additional shipping and packaging costs incurred due to partial deliveries will be borne by LOR.

In the event that LOR does not comply with the delivery terms, the customer will have the right to terminate the contract only after an unsuccessful additional period of time established by the customer for the performance by LOR.

LOR will have the right to terminate the sales contract in the event that one of its suppliers violates its contractual obligation and does not supply LOR with the ordered goods under the terms of this contract. In this case, LOR will promptly inform the customer of the unavailability of the ordered goods and will promptly refund any payments already made by the customer. It is understood that, if the customer is a consumer, such payments must be reimbursed by LOR no later than 30 (thirty) days from the date of placing the order by the customer.

Sales of products via the Internet are governed by articles 45 to 67 of Legislative Decree 21/2014 (Consumer Code). This legislation provides in favor of the consumer the right to withdraw from contracts or contractual proposals, guaranteeing him the right to return the purchased product and to obtain reimbursement of the expenses incurred. The right of withdrawal does not apply to audiovisual products and sealed computer software products opened by the consumer, nor to sealed goods that do not lend themselves to being returned for hygienic reasons or related to health protection that have been opened after delivery or in case for the supply of products that are, after delivery, inseparably mixed with other goods.

The Customer is responsible for the decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the products.

The right of withdrawal is reserved exclusively for consumers (natural persons who purchase goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore it cannot be exercised by legal persons and by natural persons acting for purposes related to the activity. professionally carried out.

The costs of returning the product are charged to the customer.

Procedures and times for exercising the right of withdrawal

The Customer has the right to withdraw from the order placed, without giving any reasons, within 14 days from the day you received the ordered product. The withdrawal period expires after 14 days from the day on which you or a third party other than the carrier and designated by you acquire physical possession of the goods.

Within this period, the Customer must communicate to LOR the desire to withdraw from the contract in one of the following ways:

Within 3 (three) working days of receiving the notice of withdrawal, LOR will send the Customer, to the email address indicated in the order or in the withdrawal request, the Return Authorization Number (NAR) which will identify the practice.

Within 14 (fourteen) days of receipt of the Return Authorization Number (NAR), the Customer will, at his own expense, ship the product carefully packed, indicating on the packaging the Return Authorization Number (NAR) attributed by LOR, at the following address:

The address to which the products should be sent will be clearly indicated in the communication email of the NAR.

The deadline is considered met if the Customer sends the product before the expiry of the period of 14 (fourteen) days.

Methods and times for refunding the cost of the product and shipping costs to the Customer

Pursuant to Article 56 of Legislative Decree 21/2014, LOR will refund all payments within 14 (fourteen) days from the date on which it became aware of the Customer’s exercise of the right of withdrawal, including delivery costs (with the exception of additional costs resulting from the possible choice of a type of delivery other than the least expensive type of standard delivery offered by LOR); in any case, the Customer will not have to incur any costs as a consequence of this reimbursement.

LOR may withhold the refund until it has received the product intact or until the Customer has demonstrated that he has returned the goods, whichever occurs first.

For purchases made with one of the following payment methods:

Bank transfer
LOR will proceed with the refund by bank transfer.

For purchases made by credit card payment, the refund will be made by reversing the transaction directly on the credit card.

For purchases made through PayPal payment, the refund will be made by crediting the Customer’s account.

If the returned items show damage or signs of wear resulting from unnecessary handling to establish the nature, characteristics and functioning of the same, we may withhold from the refund an amount corresponding to their decrease in value.

Items returned because they are incorrect, damaged or faulty

If you return an item due to our mistake or because the item is damaged, defective or not what you ordered, and it was not possible to repair or replace, you will be refunded the cost of the item, expenses shipping costs incurred to receive it and those eventually faced to return the item to us.

Pursuant to Legislative Decree 206/2005 (“Consumer Code”) all the products for sale on the site are covered by the legal guarantee of 24 months.

Based on the 24-month legal guarantee, LOR is liable to the consumer (the natural person acting for purposes unrelated to any business, commercial, craft or professional activity carried out) for any lack of conformity not found at the time of purchase. The lack of conformity exists when the product is not suitable for the use to which it must habitually serve, does not conform to the description or does not possess the qualities promised by the seller, does not offer the usual qualities and performance of a good of the same type, does not it is suitable for the particular use desired by the consumer if brought to the attention of the seller at the time of purchase and accepted by the seller (Article 129 of the Consumer Code).
The lack of conformity that occurs within 24 months from the date of purchase of the goods must be reported within 2 months from the date of discovery of the defect.
Unless proven otherwise, it is assumed that the lack of conformity that occurs within 6 months of delivery of the goods already existed on that date. In the event of a lack of conformity, the consumer has the right to restore, without charge, the conformity of the goods by repair or replacement (Article 130 of the Consumer Code).

LOR will remedy the quality defects within a reasonable period of time (subsequent execution) by eliminating the defect (repair) or by delivering defect-free goods (replacement). In the event of a subsequent failure to perform or that this is not acceptable to the client or is refused by LOR, or where it is not justified for any other reason, taking into account the interests of both arts, the client will have the right, without limitation legal rights, to terminate the contract or to reduce the amount and, where applicable, to compensation for damages and reimbursement of expenses. However, there is no right to terminate the contract if the defect is purely insignificant in terms of quality.
The consumer can ask the seller, at his choice, to repair the good or replace it, without charge in both cases, unless the requested remedy is objectively impossible or excessively expensive compared to the other. Any repairs or replacements must be completed by LOR within a reasonable period of time and without any significant disturbance to the customer, taking into account the nature of the goods. The consumer may request an adequate discount on the price or the termination of the contract in the event that: (a) the repair or replacement is impossible or disproportionate; (b) LOR has not remedied within a reasonable period of time; or (c) LOR did not complete the remedial action without causing significant inconvenience to the client.
LOR will cease to be responsible in the event that the customer personally modifies the goods or has them modified by a third party without having obtained the consent of LOR, unless the customer proves that the quality defects in question were not caused either in in whole or in part by this modification and that the aforementioned modification does not make subsequent execution more difficult.

LOR is not responsible for quality defects resulting from normal wear, external shocks or incorrect use.

Times and methods of exercise of the Legal Guarantee
The Customer must send a written communication to LOR (for convenience, the “Contacts” section can also be used) or contact LOR by telephone at 0712867616, indicating the defect of the product; wait for the Return Authorization Number (NAR) identifying the file that will be communicated by LOR; prepare the product for shipment by carefully packing it and enclosing all accessories, the instruction manual and everything originally contained in the product packaging; indicate on the packaging the Return Authorization Number (NAR) assigned by LOR.

The carrier will contact the Customer to arrange the withdrawal of the product (the Customer’s unavailability by telephone will delay the withdrawal of the product).

Retention of
title LOR will remain the owner of the goods until full payment of the amount due.

In the event that the customer fails to pay in full the amount due, LOR shall have the right to terminate the contract once a reasonable additional time for payment has elapsed without success. Upon termination, LOR will take back the goods and, as the case may be, may require the customer to transfer all rights to redeem the goods vis-à-vis third parties to LOR.

Jurisdiction
For the resolution of any civil disputes arising from the interpretation, execution and termination of this distance sales contract, if the Customer is a consumer (ie a natural person who purchases the products not for purposes related to his professional activity) the mandatory territorial jurisdiction lies with the judge of the place of residence or domicile of the consumer himself, if located in Italy (Article 66-bis of Legislative Decree 21/2014).
